Musk and his legal counsel denied the request, citing the “privilege of the investigation,” something that both the court and Twitter’s lawyers have questioned. As of now, it’s not clear exactly what it’s being investigated for, but it’s about the acquisition. It is also unknown which federal agency is investigating him at this moment.
It remains to be seen if that will be clarified and whether the court will compel Musk and his lawyer to produce the above documents, but this is certainly a unique situation.
