On Thursday, the Abakaliki District of the Federal Supreme Court invalidated the Local Government Area (LGA) elections held in Ebonyi on July 30.

The All Progressives Party (APC) dominated the elections, which were conducted by the Ebonyi State Independent Electoral Commission (EBSIEC).

It happened in the state’s 13 LGA districts and 171 wards.

However, some members of the Inter-Party Advisory Council (IPAC) boycotted the elections due to N1 million and N200,000 nomination fees for presidential and council seats, respectively.

The group then petitioned the court in Case No. FHC/AI/CS/151/2022 to invalidate the election results.

Judge Faton Reimann ruled that the election was invalid.

Mr. Riemann described the activity as undemocratic and illegal.

The petitioner’s lawyer, Modi Erhindi, praised the court’s “sound verdict” in an interview with journalists following the ruling.

Mr. Erhandi argued that it was illegal to hold local assembly elections “without providing the petitioner with the exact laws intended to regulate the process”.

He said: “There are many other issues that are incompatible with the amended election law of 2022.

According to the law, government electoral commissions must abide by election procedures when elections are held in local government areas.

“My current position is that my clients have demanded access to this law.

We have sent letters to EBSIEC, the House of Representatives, and INEC, but they have refused to provide us with applicable law.

Mr. Erhandi stated, “The law can assist candidates in determining when to act within or against the law during such elections.”

Defense attorney Roy Noyes could not be reached for comment on the ruling.

In response to the ruling, Governor David Amehi urged law-abiding residents of the state to remain calm and go about their business without incident.

Chooks Oko, his special assistant for media and strategy, released a statement made available to reporters at Abakaliki containing his response.

“Our lawyers will analyze the ruling to determine the best course of action.

The statement continued: “My belief in the judiciary as a bulwark of justice and equity has not wavered.”
