San Francisco District Attorney Brock Jenkins issued this statement:

After the San Francisco Police Department’s investigation and review of all evidence presented, my office issued an arrest warrant for Collier-Gwen. Gowen will be charged with misdemeanor battery for allegedly intentionally and unlawfully spraying water on and around a woman experiencing homelessness on January 9, 2022.

The alleged battery of a homeless member of our community is completely unacceptable. Mr. Gwen will face the appropriate consequences for his actions. Likewise, vandalism at Foster Gwen’s gallery is also completely unacceptable and must stop – two wrongs don’t make a right.

In the background:

  • Although the victim did not seek to bring charges in this case, the evidence collected was sufficient to proceed to charge Mr. Gowen with misdemeanor battery (242 pc.)
  • The District Attorney’s office issued an arrest warrant for Collier-Gwen
  • The arrest warrants issued by the Office of the Public Prosecutor are different from the arrest warrants issued by the courts for “Rami”. DA orders include the criminal complaint and the specific charge(s) and/or allegations that the individual faces. Arrest warrants for Ramy are issued by a court when law enforcement agencies provide sufficient probable cause for the arrest.
  • If convicted, Mr. Guinn faces up to six months in county jail and a $2,000 fine.
  • Once Mr. Gowen has been arrested/cited, his trial date will be set
  • And at trial, Mr. Gowen is expected to plead on every count prosecutors bring
