Lydell Grant was acquitted in 2019, owed $673,333 from the state amid a new murder charge stemming from road rage

Houston, Texas (KTRK) – A man once serving a life sentence and later found innocent finds himself behind bars and accused again of murder.

Records show Lydell Grant owes hundreds of thousands of dollars from the state and will continue to be paid while the new murder charge is played out in court.

He will only stop getting paid if he is convicted.

Houston police arrested Grant last week on a murder charge, charged with the murder of Edwin Arevalo, 33, in the roadside shooting of Hiram Clark.

The judge set his bond at $1 million.

Grant is the same man who made national headlines after he was acquitted of the murder for which he was sentenced to life in prison.

He was convicted of fatally stabbing 28-year-old Aaron Scherhorn in a Montrose bar in 2010. He spent seven years behind bars before being declared innocent by the Texas Court of Criminal Appeals in 2021.

The DNA test did not match, and a new suspect linked to the crime confessed.

According to the National Acquittal Registry, Grant owes $673,333 for the wrongful conviction.

According to Cassandra Jo of the Texas Innocence Network at the University of Houston Law Center, Texas makes annual payments, so Grant hasn’t received all of those payments yet. Jeu says he will continue to get paid for the wrongful conviction while the last case is in court unless there is a conviction through a plea bargain or trial.

“Texas is the most generous state when it comes to compensation law in the entire United States,” said Joe. “It saves $80,000 for each year the person was in prison and $25,000 per year for each year the person was on probation, parole, or sex registration.”

If Grant is convicted, Joe says the law does not oblige him to return the money he has already received.

The Innocent Project of Texas played an important role in proving Grant’s innocence.

In a statement to ABC13, a spokesperson for the Texas Innocence Project wrote in part:

“We are saddened by the news of this tragic incident, and our thoughts and sympathies go out to the victim’s family. Because this is an ongoing investigation, we cannot comment on the specifics of this incident. We stand behind Mr. Grant’s previous acquittal, which was granted by the Texas Court of Criminal Appeals.”
