Court documents filed in the US District Court for the Northern District of Mississippi said the boy, Adrian Morey, was turning at the corner of the entrance to his home when he was shot by Greg Capers, one of the responding officers, after police were called to the family home around 4 a.m. on May 20. “He was trying to help protect his mother,” said Carlos Moore, the family’s attorney, adding that Adrienne told a 911 dispatcher that the man did not have a gun and that there were children in the house.

Court documents said law enforcement did not properly “assess the situation” before unloading the firearm. The lawsuit said Morey sustained severe injuries as a result of the gunshot wound, including a collapsed lung, ruptured liver and broken ribs.

The lawsuit alleges that many complaints have been filed against Officer Capers for excessive force and abuse and that prosecutors will show a consistent pattern.

In addition to Officer Capers, the lawsuit includes Police Chief Ronald Sampson and five other unidentified police officers. Requests for comment from Indianola Mayor Ken Featherstone and Indianola Police spokesman Kedrick Wash were not immediately responded to.

The Mississippi Bureau of Information told CBS News last week that this is an open and active investigation and that no further comment will be made.
