AJ Armstrong case: Judge files to change venue for third trial of man charged with 2016 murder of parents Don and Antonio Armstrong

Houston, Texas (KTRK) – A judge in the case of AJ Armstrong has said publicly that the court does not feel he can get a fair trial in Harris County and has applied to change the venue for the third trial.

ABC13 spoke with Judge Kelly Johnson after she filed a late motion, ordering a hearing to decide whether to move the trial to another location.

It became important because it was the judge who called this session, not the prosecution or the defense.

AJ Armstrong has been on trial twice in Harris County for the 2016 murder of his parents, Don and Antonio Armstrong Sr.

Below is a breakdown of the two juries:

  • 2019: Eight have said AJ is guilty, and four have said not guilty
  • 2022: Four have said AJ is guilty, and eight have said he is not guilty

The motion presented does not guarantee that the trial will be moved, as both sides will present their cases for and against.

Currently, jury selection is scheduled for February 24. Johnson told ABC13 she expects the decision to happen within two weeks.

Eyewitness News also reached out to AJ Armstrong’s defense team, but they declined.

Since no final decision has been made, it is unclear where it might be held.
